Important – Coronavirus (COVID-19) & unfair dismissal claims
The current coronavirus (COVID-19) situation is affecting how the Fair Work Commission manages unfair dismissal claims. However, it is still possible to lodge an unfair dismissal application during times of COVID-19.
In order to ensure the safety of applicants the Fair Work Commission have closed our counters across Australia. They are no longer accepting unfair dismissal applications in-person or by post. It is recommended you do the following:
- Seek representation in order to lodge the correct forms, properly formatted, and on time.
- You can also attempt to complete the Form F2 Unfair Dismissal Claim and send it by email or fax to your nearest commission office.
If you’re requiring assistance regarding an unfair dismissal claim, please call us on 1300 766 700.
The 21-day time limit for unfair dismissal claim lodgements will still apply during COVID-19 for all states and territories of Australia.
It is possible for an unfair dismissal claim to take longer than usual to process due to COVID-19 restrictions. It is also likely that, if your case is unable to be resolved by phone conciliation, any hearing or conference will be undertaken via phone or online video conference. This means that the Fair Work Commission can deal with your entire case without you having to enter the Commission.
